Lawsuit against state questions could be refiled

A Tulsa attorney says a lawsuit that has been dropped over two state questions on the ballot in November could be refiled if the proposals pass.

Attorney James C. Thomas filed the suit opposing State Question 746, which would require voters to present a government-issued photo ID when voting, and State Question 751, which would require all official state government communications to be issued in English except for American Indian languages and as otherwise required by federal law.

The suit in Tulsa County District Court was dropped last week, but Thomas told The Oklahoman he thinks both measures likely will pass and if they do, he will refile the lawsuit “within days” of the election.

He wants a judge to rule that both measures are unconstitutional and should not be enacted.
