BILLINGS, Mont. (AP) – A Billings man has been sentenced to three years in federal prison for failing to register as a sex offender when he moved between Billings and the Fort Peck Indian Reservation.
Thomas D. Smith, 34, was sentenced Jan 9th by U.S. District Judge Jack Shanstrom.
Smith was convicted in federal court of abusive sexual conduct in 1996 and was arrested in 2003 and 2007 for failing to register as a sex offender.
Smith was sentenced under the Adam Walsh Act, named for the murdered son of America’s Most Wanted host John Walsh. It calls for up to 10 years in prison for sex offenders who fail to register with local authorities when moving between states or between states and Indian reservations.
In Glendive, 37-year-old Jesse L. Vardaro was arrested recently for failing to register as a sex offender after moving to Montana from another state.
U.S. Marshal Dwight MacKay said Vardaro was convicted of indecency with a child by contact in Texas in 1990. He was arrested while working on a geological survey crew near Glendive. Officials say he will be prosecuted under the Adam Walsh Act.
