Both men set for trial in 1975 Pine Ridge slaying

Both men charged with killing a fellow American Indian Movement member 33 years ago are scheduled to stand trial in October in Rapid City.

Richard Marshall and John Graham pleaded not guilty to charges they committed or aided and abetted the December 1975 murder of Annie Mae Aquash (AH’-kwash) on the Pine Ridge Indian Reservation.

An appeals court during July upheld the dismissal of one of the three alternate murder charges against Graham.

U.S. Attorney Marty Jackley says the government is still weighing its options in relation to the alternative charge that was dropped.

If prosecutors don’t try Graham on the two remaining counts against him, the state could do it.
