Judge reserves decision in cigarette mailing case

A federal ban on mailing cigarettes remains in place for now.

Lawyers for the government and Seneca Indian businesses were in U.S. District Court in Buffalo Tuesday for a hearing on the new Prevent All Cigarette Trafficking Act – the new law that prohibits cigarette sellers from delivering tobacco by mail and requires them to comply with various states’ taxing regulations.

The Seneca businesses asked the judge to stop the government from enforcing the PACT Act while they appeal a July 30 court ruling that upheld the mail ban while temporarily exempting the businesses from the taxation provisions.

That government, meanwhile, asked the judge to reconsider the taxing exemptions.
